Bribery Criminal Defense Lawyer
Barry Bernstein is an experienced bribery criminal defense lawyer who has been defending the rights of his clients in criminal defense cases in Southern California for over 30 years. As is the case with many white collar crimes, proof can be the main deciding factor in a conviction. Mr. Bernstein’s experienced and aggressive defense techniques will use this and other factors, such as accounting and forensic issues. Without a successful defense, the accused can face fines up to three times the value or amount of the bribe and, in some cases, up to 15 years in prison. That doesn’t include the revocation of official titles and positions.
Types of bribery
At this time, bribery around the world is estimated at approximately one trillion dollars. Bribery is the giving or receiving of money, goods, or services to influence the actions of an official or person assigned with a legal or public duty. It can include money, goods, property, privilege, services, or preferment, to name a few. Any promise or action to induce the action, vote, or influence of a person in an official or public capacity falls under bribery. There are several types of bribery, as outlined below:
- Bribery by or of a public official, or by or of a witness. A public official is any individual acting on behalf of the United States, such as a judge, witness, congressman, or member of a jury. The potential penalty for the public official (demanding or accepting the bribe) can be up to three times the amount of the bribe and/or a prison term of up to 15 years, as well as the prohibition of holding office again. The penalty for the individual offering or paying the bribe can be a fine or up to two years in prison.
- Bribery of a foreign official. It is illegal for an American business to give money, gifts, or services to foreign government officials in order to secure or retain business contacts.
- Bank bribery. This includes bribery of a bank employee or individual who holds a position of status in a bank.
- Bribery in sporting contests. The accused referee, judge or other sports official can face a fine and up to 5 years imprisonment if convicted of bribery.
